The court issues its mandate, which returns the case to the originating tribunal, seven days after either the time to file a petition for rehearing expires or the court denies the petition for rehearing. In some cases, the court may shorten or extend the time to issue the mandate. See Fed. R. App. P. 41.
Similarly, a decision by one district court in New York is not binding on another district court, but the original court’s reasoning might help guide the second court in reaching its decision. Decisions by the U.S. Supreme Court are binding on all federal and state courts.
Publication of court judgments has long been standard practice in line with the principles of open justice. The individual judges who hand down judgments have the right to determine whether the judgment text should be published. By the early 21st century, judgments intended for publication were circulated to legal publishers by email.
